Introduction

Dear Customer,

These Terms and Conditions govern the process of concluding sales agreements through the above-mentioned website, the rules for the performance of such agreements, including delivery, the rights and obligations arising from applicable law, as well as the procedure for withdrawal from the agreement and the complaint process.

These Terms and Conditions consist of four main sections:

  • Sections 1–3 contain the general provisions of these Terms and Conditions.

  • Sections 4–7 describe the process of purchasing Goods and Services.

  • Sections 8–12 contain provisions concerning defective Goods and Services as well as the right of withdrawal from the agreement.

  • Section 13 contains all remaining provisions.

1. Basic Definitions

Customer – a natural person with full legal capacity, and in cases provided for by generally applicable law also a natural person with limited legal capacity, a legal entity, or an organisational unit without legal personality to which the law grants legal capacity, who has concluded or intends to conclude a sales agreement.

Consumer – a natural person acting for purposes outside their trade, business, craft, or profession, within the meaning of applicable consumer protection laws.

Sales Agreement – an agreement for the sale of a Product offered through the Online Store, concluded between the Customer and the Seller via the Online Store.

Goods – products offered through the Online Store, including new and used vinyl records and accessories.

Order – a declaration of intent submitted by the Customer via the Online Store specifying the type and quantity of Goods ordered, the payment method, delivery method, delivery address, and Customer details.

Order Form – an electronic service available through the Online Store enabling the Customer to place and complete an Order, including by adding Products to the shopping cart and selecting delivery and payment methods.

Order Processing Time – the period during which an Order placed by the Customer is completed, packed, prepared, and handed over to the selected delivery carrier by the Seller.

Business Day – any day from Monday to Friday, excluding public holidays.

Consumer Rights Act – the Polish Consumer Rights Act of 30 May 2014, as amended.

2. General Provisions

The Seller declares that it complies with all applicable personal data protection regulations, including the Polish Personal Data Protection Act of 10 May 2018 and Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR).

The Customer consents to the collection, storage, and processing of personal data by the Seller solely for purposes directly related to the fulfilment of ordered Goods or Services. Detailed information regarding the collection, processing, and protection of personal data can be found in the Store's Privacy Policy.

Before placing an Order, the Customer has the opportunity to review these Terms and Conditions and accepts them by selecting the appropriate checkbox during the checkout process. Acceptance of these Terms and Conditions is required for Order fulfilment.

Please note that concluding a Sales Agreement via the Internet and accepting these Terms and Conditions creates an obligation to pay for the Goods ordered.

The Seller applies appropriate technical and organisational measures to ensure the security of personal data and to protect it against unauthorised access, disclosure, alteration, destruction, or loss.

Every person whose personal data is processed has the right to:

  • obtain information regarding the processing of their personal data;

  • access their personal data;

  • request correction, updating, or completion of their personal data;

  • request restriction of processing;

  • request deletion of personal data where permitted by law;

  • obtain information regarding the purpose, scope, and duration of data processing;

  • learn the source of personal data where legally permissible.

The Customer may subscribe to the Store's newsletter and consent to receiving commercial and marketing information electronically.

Customers using the Online Store are obliged to comply with these Terms and Conditions to the extent necessary for the proper fulfilment of Orders and in accordance with applicable law and principles of social conduct.

The Seller fulfils Orders within Poland and throughout Europe. Orders from other countries may be accepted upon prior agreement regarding delivery conditions.

All Goods offered through the Online Store have been legally introduced to the market and comply with applicable laws and regulations.

Information provided about Goods on the Online Store website constitutes an invitation to conclude an agreement within the meaning of applicable civil law.

3. Terms of Service

The Online Store provides services electronically. Entering into a Sales Agreement requires completion of the online Order Form.

The conclusion of an agreement is voluntary.

The electronic service agreement concerning the use of the Order Form is concluded when the Customer begins completing the form and ends when the Customer either abandons the form or submits it to the Seller.

The Order Form process is designed to allow Customers to review all information before deciding whether to conclude an agreement or modify its terms.

The service described above is provided free of charge; however, access to the Internet may be required.

Orders may be placed electronically 24 hours a day, 7 days a week.

During the checkout process, the Customer must consent to the processing of personal data to the extent necessary for Order fulfilment. Providing personal data is required for placing an Order.

In accordance with Article 8(2) of the GDPR, the Seller makes reasonable efforts, taking available technology into account, to verify parental consent where required for persons under 16 years of age.

Any costs related to Internet access or data transmission are borne solely by the Customer according to the terms agreed with their Internet service provider.

4. Terms of the Agreement

In order to conclude a valid and binding Sales Agreement, the Customer selects Goods from the Online Store's current offer, specifying the quantity of Goods they wish to purchase and, where applicable, selecting the characteristics and specifications of the Product.

Along with selecting the Goods, the Customer completes the online Order Form, providing all information necessary for order fulfilment, including delivery details and payment method, based on the information and instructions displayed on the website and contained in these Terms and Conditions.

Creating a Customer Account in the Online Store is voluntary and free of charge.

Immediately after receiving the Order, the Seller shall send an electronic confirmation of Order acceptance to the email address provided by the Customer during checkout. The Sales Agreement is concluded at the moment the Customer receives this confirmation.

The Order confirmation email contains all agreed terms of the Sales Agreement, including in particular the type and quantity of Goods ordered, their specifications (where applicable), the total price payable (expressed in Polish Złoty – PLN), delivery costs, and any discounts granted.

If the Customer is entitled to multiple discounts originating from different promotions or sources, such discounts may only be combined where explicitly stated in the terms of the relevant promotion. Unless otherwise specified, only one discount or promotional offer may be applied to a single purchase.

5. Order Fulfilment

The Seller processes Orders in the order they are received. Every Order is treated as a priority and handled with the utmost care.

Should exceptional circumstances arise, or if the Seller is unable to fulfil an Order within the expected timeframe, the Customer will be contacted without delay in order to agree on further arrangements, including a revised fulfilment date or an alternative delivery method.

Order processing begins once the Online Store receives confirmation of successful payment from the selected payment service provider.

6. Delivery

Goods are delivered within Poland and internationally via courier services (InPost Courier, InPost Parcel Locker®, DPD Courier, DPD PickUp) or by any other delivery method mutually agreed upon by the Seller and the Customer, provided that such method does not involve unreasonable or excessive costs for either party.

Free shipping is available for DOMESTIC orders only over 400 PLN when selecting either InPost Parcel Locker® or DPD PickUp delivery.

All Orders are dispatched within 24 hours.

Estimated delivery times are:

  • Domestic shipments (Poland): 24–48 hours

  • International shipments (European Union): 2–5 business days, depending on the carrier

Pre-Orders

Products purchased as pre-orders will be shipped no earlier than the date specified in the product's shipping information.

The Seller reserves the right to change the estimated shipping date for pre-order products. The stated shipping date is indicative only and may be affected by circumstances beyond the Seller's control, including delays caused by manufacturers, pressing plants, distributors, or courier companies.

By placing a pre-order, the Customer acknowledges and accepts the possibility of changes to the estimated shipping date.

If an Order contains both in-stock and pre-order items, the entire Order will be shipped once all pre-order items become available. The fulfilment and shipping date of the entire Order will therefore correspond to the shipping date of the pre-order item(s).

Goods are delivered according to the Customer's choice, either to the delivery address provided during checkout or collected in person from the designated pickup location.

All Goods are packaged appropriately according to their nature to ensure protection against damage, loss, or destruction during transport.

The Customer is informed of delivery costs during the checkout process. Shipping costs depend on the destination country, the quantity and weight of the Goods ordered, and the selected shipping method.

7. Payment Methods

Online payments in the Store are processed by one of the following payment service providers, selected during checkout:

  • PayPro S.A. (Przelewy24)

  • UniCredit S.p.A. Branch in Poland (InPost Pay)

The Customer may pay for an Order immediately using one of the available payment methods. Payment details are either automatically completed or not required, reducing the risk of errors during the payment process.

Once the payment has been confirmed, the funds are transferred directly to the Store, allowing Order processing to begin without waiting for bank transfer confirmation.

All payments made through the Store are fully secure, encrypted, and protected by SSL certification.

Buy with InPost (InPost Pay)

Currently the fastest and most convenient payment method, provided that you are an InPost app user.

Simply add products to your InPost cart in our Store, and they will automatically appear in your InPost application, where you can complete both payment and delivery selection. The entire process is automated and does not require entering shipping details manually.

Instant Bank Transfer (Przelewy24)

A convenient payment method based on online bank transfers, without the need to manually enter payment details such as the recipient's bank account number, transfer amount, or payment reference.

After logging into your online banking service, simply confirm the transaction, for example using an SMS authorization code.

BLIK

A fast and secure payment method using a one-time authorization code generated in your banking application.

A payment method requiring the Customer to enter debit or credit card details and authorize the transaction.

A convenient payment method using a smartphone or compatible device. These digital wallets use a linked payment card to complete transactions quickly and securely.

8. Statutory Warranty Liability

Delivery of Goods in connection with claims arising from statutory warranty liability shall be carried out at the Seller's expense.

The Seller shall be liable under statutory warranty provisions if a defect is discovered within two years from the date the Goods are delivered to the Consumer.

The Seller shall be liable if, at the time of delivery, the Goods were not in conformity with the Sales Agreement or contained physical or legal defects.

A defect shall be deemed to exist in particular where the Goods:

  • do not possess the characteristics normally expected of goods of that type, considering their intended purpose or ordinary use;

  • do not possess the characteristics assured by the Seller, including through samples or examples;

  • are unsuitable for a purpose made known by the Buyer to the Seller at the time of concluding the Agreement, unless the Seller raised objections to such intended use;

  • were delivered incomplete.

Notifications regarding defects should be submitted either:

  • electronically to the Seller's email address, or

  • in writing to the Seller's postal address specified in Section 1 ("Seller's Address").

If a Consumer experiences difficulties preparing a defect notification, they may use the complaint form attached as Appendix No. 2 to these Terms and Conditions. Use of this form is optional and serves only as a convenience.

Where necessary for the proper assessment of a defect, and following prior consultation with the Seller, the Goods should be delivered to the Seller's address, provided the nature of the Product allows for such delivery.

The Seller shall respond to a Consumer's complaint without undue delay and no later than within 14 calendar days of receiving it.

Failure to respond within this period shall be deemed acceptance of the complaint and acknowledgement of its validity.

The Seller shall bear the costs of collecting the Goods, shipping, repair, defect removal, and replacement of defective Goods with new Goods.

9. Withdrawal from the Agreement

In accordance with applicable law, and in particular Article 27 of the Polish Consumer Rights Act of 30 May 2014, a Customer acting as a Consumer has the right to withdraw from a distance sales agreement without giving any reason.

The right of withdrawal may be exercised within 14 calendar days from the date on which the Consumer, or a third party indicated by the Consumer other than the carrier, takes possession of the Goods.

If the Consumer withdraws from the Agreement, the Agreement shall be considered void, and the parties shall return all performances received from one another. Returned Goods should remain unchanged, except where changes were necessary to establish the nature, characteristics, and functioning of the Goods.

The Consumer may withdraw from the Agreement by submitting a declaration of withdrawal via email to:

To meet the withdrawal deadline, it is sufficient to send the declaration before the expiry of the 14-day period.

The Seller shall promptly confirm receipt of the withdrawal notice and provide the Customer with information regarding the return procedure.

The Seller shall reimburse all payments received from the Customer, including the original delivery costs, no later than 14 calendar days from the date of receiving the withdrawal notice.

Refunds shall be made using the same payment method used by the Customer during the original transaction unless the Customer expressly agrees to a different method that does not involve any additional costs.

If the Seller has not offered to collect the Goods directly, the Seller may withhold reimbursement until the returned Goods have been received or until proof of return shipment has been provided by the Customer, whichever occurs first.

The Customer shall return the Goods to the Seller, or hand them over to a person authorised by the Seller, without undue delay and no later than 14 calendar days from the date of withdrawal from the Agreement.

The deadline is met if the Goods are shipped before the 14-day period expires.

The Consumer shall bear the direct cost of returning the Goods.

IMPORTANT NOTICE FOR INTERNATIONAL ORDERS

For orders delivered outside Poland, all return shipping costs are the responsibility of the Customer and will not be reimbursed by the Seller.

The Consumer has the right to withdraw from a distance contract without giving any reason. In the event of withdrawal, the Consumer shall bear only the direct cost of returning the Goods, unless otherwise required by applicable consumer protection laws.

Returned Goods should be sent to the Seller's address specified in Section 1 of these Terms and Conditions.

The Consumer is liable for any diminished value of the Goods resulting from handling them in a manner beyond what is necessary to establish their nature, characteristics, and functioning. The Consumer may inspect and evaluate the Goods only to the extent that would be possible in a physical retail store.

The right of withdrawal does not apply to agreements specified in Article 38 of the Polish Consumer Rights Act, including but not limited to:

  • services that have been fully performed with the Consumer's prior express consent and acknowledgement that the right of withdrawal would be lost upon completion;

  • goods or services whose price depends on fluctuations in the financial market beyond the Seller's control;

  • non-prefabricated goods manufactured according to the Consumer's specifications or clearly personalised goods;

  • goods that are liable to deteriorate or expire rapidly;

  • sealed goods which are not suitable for return for health protection or hygiene reasons once unsealed after delivery;

  • goods which, after delivery, become inseparably mixed with other items due to their nature.

10. Complaints Procedure

To submit a complaint correctly, the Customer should provide:

  • full name or company name;

  • residential or registered address;

  • email address;

  • description of the complaint;

  • where possible, the Order number;

  • the period to which the complaint relates;

  • circumstances justifying the complaint.

If the Customer is a Consumer, they may request replacement of defective Goods, repair of the defect, or another remedy available under applicable consumer protection laws, unless the chosen remedy is impossible or would involve disproportionate costs compared to an alternative solution.

Unless otherwise required by law, the Seller shall respond to a Consumer's complaint within 14 days of receipt.

If the Seller fails to respond within this period, the complaint shall be deemed accepted.

Responses to complaints shall be provided electronically.

Failure to respond within the prescribed period shall not automatically constitute acceptance of a request for withdrawal from the Agreement.

11. Liability

The Customer is not permitted to:

  • publish personal data of third parties without the required authorization or consent of the person concerned;

  • publish advertising or promotional content unrelated to the purpose of the Online Store.

The Customer is prohibited from publishing content that may, in particular:

  • infringe the personal rights of third parties;

  • be submitted in bad faith or reasonably considered to have been submitted in bad faith;

  • infringe the rights of third parties, including copyrights, related rights, industrial property rights, trade secrets, or information subject to confidentiality obligations;

  • contain offensive, abusive, threatening, defamatory, or vulgar language;

  • infringe the legitimate interests of the Seller;

  • constitute unsolicited commercial information (spam);

  • otherwise violate applicable law, accepted standards of conduct, social norms, or good practices.

Upon receiving a notification from an authorized person, a third party, or a public authority, the Seller reserves the right to modify or remove content published by the Customer if such content may violate these Terms and Conditions or applicable laws.

The Seller does not continuously monitor content published by Customers.

12. Out-of-Court Complaint Handling and Dispute Resolution

Information regarding out-of-court complaint handling procedures and methods of pursuing claims is available from:

  • local Consumer Ombudsmen;

  • consumer protection organizations;

  • Provincial Inspectorates of Trade Inspection;

  • the Polish Office of Competition and Consumer Protection (UOKiK).

A Consumer may in particular:

  • request mediation proceedings before the Provincial Inspector of Trade Inspection;

  • submit a dispute to a permanent consumer arbitration court operating at a Provincial Inspectorate of Trade Inspection;

  • seek free legal assistance from consumer organizations, including the Consumer Federation (Federacja Konsumentów).

Cross-border disputes may also be resolved with the assistance of the European Consumer Centres Network (ECC-Net).

Consumers may additionally use the European Online Dispute Resolution (ODR) platform established under Regulation (EU) No. 524/2013:

The use of out-of-court dispute resolution procedures is voluntary and requires the consent of both parties to the dispute.

13. Final Provisions

The Online Store respects all rights granted to Customers under applicable law.

If mandatory provisions of applicable law grant Consumers rights more favorable than those contained in these Terms and Conditions, such provisions shall prevail and replace the relevant provisions of these Terms and Conditions.

All content available on the Online Store website, including graphics, text, page layouts, and logos, is protected by copyright and remains the exclusive property of the Seller. Any use of such content without the Seller's prior written consent may result in civil and criminal liability.

As the controller of personal data, the Seller informs Customers that:

  • providing personal data is voluntary but necessary for Order fulfilment;

  • data subjects have the right to access, rectify, erase, restrict processing, transfer their data, and withdraw consent at any time;

  • personal data may be disclosed to competent public authorities where required by law;

  • personal data is processed on the basis of Article 6(1) of the GDPR and other applicable legal provisions;

  • personal data will be stored only for the period necessary to fulfil Orders and process any related claims, and in any case no longer than three years;

  • data subjects have the right to lodge a complaint with the President of the Personal Data Protection Office (UODO) if they believe their data is being processed unlawfully.

Personal data is protected using appropriate technical, organizational, and legal safeguards.

Personal data may be processed in an automated manner, including profiling where applicable.

For matters not regulated by these Terms and Conditions, the provisions of Polish law shall apply, including in particular:

  • the Polish Civil Code;

  • the Consumer Rights Act of 30 May 2014;

  • the Act on the Provision of Electronic Services;

  • the Industrial Property Law Act;

  • the Copyright and Related Rights Act;

  • the GDPR and applicable personal data protection regulations.

Any amendments to these Terms and Conditions shall be binding provided that Customers are properly notified in accordance with applicable law.

The Seller reserves the right to amend these Terms and Conditions for important reasons, including:

  • changes in applicable law;

  • changes in payment methods;

  • changes in delivery methods;

  • significant changes in currency exchange rates;

  • changes in the provision of electronic services;

  • changes to the Seller's business details, including email address or telephone number.

Amendments shall not affect Orders already placed and being processed. Such Orders shall be governed by the Terms and Conditions in force at the time the Order was placed.

The Seller shall publish information regarding planned amendments at least 30 days before they take effect.

In the event of non-acceptance of amended Terms and Conditions, Customers may terminate the electronic services agreement within 30 days of receiving notification of the changes.

Disputes arising from agreements concluded under these Terms and Conditions shall be submitted to the competent court in accordance with applicable provisions of Polish law.

The appendices to these Terms and Conditions form an integral part thereof.

Sales Agreements are concluded in the English language and in accordance with these Terms and Conditions.

Customers may access these Terms and Conditions at any time through a link available on the Online Store website, as well as download and print them for personal use.

These Terms and Conditions shall enter into force on 20 February 2025.

Copyright Notice

All economic copyrights to the template of these Terms and Conditions are owned by LEGATO Law Firm, which has granted the Seller a non-exclusive and non-transferable right to use this document solely for the purposes of its own online business activities.

Copying, distributing, or otherwise using this document without the prior consent of LEGATO Law Firm is prohibited and may result in civil and criminal liability.
